ORDINANCE NO. 01-2019
Notice is hereby provided pursuant to Sections 609(b) and 610 of the Pennsylvania Municipalities Planning Code, 53 P.S. §§ 10609(b) and 10610, that the Borough Council of the Borough of Dunmore, Lackawanna County, Pennsylvania will hold a public hearing on the 19th day of September, 2019, commencing at 6:00 p.m., ending at 8:00 pm. The hearing will be held at the Dunmore Borough Community Center 1414 Monroe Ave. Dunmore, Pennsylvania 18512, for the purpose of taking public comment and input concerning the adoption of an amendment to the Dunmore Borough Zoning Ordinance as more particularly set forth in Ordinance No 01-2019.
Copies of the proposed Ordinance have been served upon the Lackawanna County Planning Commission and the Dunmore Borough Planning Commission pursuant to applicable law. The following constitutes a summary of the contents of Ordinance No. 01-2019, prepared by the Solicitor pursuant to Section 610(a) of the Municipalities Planning Code, as amended, 53 P.S. § 10610(a). The title of Ordinance No.01-2019 is “An Ordinance of The Borough of Dunmore, Lackawanna County, Pennsylvania, Amending the Borough Zoning Ordinance” The Ordinance will be known as Ordinance No. 01-2019 and will become effective 5 days after enactment. The Ordinance amends and restates in its entirety Subsection 11.185 “Sanitary Landfill” of Article 11 “Definitions” of the Dunmore Borough Zoning Ordinance as follows:
11.185 Sanitary Landfill
A sanitary landfill is considered to be any facility devoted to the storage and/or disposal of solid wastes pursuant to the regulations of the Pennsylvania Department of Environmental Protection governing sanitary landfills. Sanitary landfills may include Staging Areas as defined in Section 11.198. Sanitary landfills shall be subject to all regulations contained herein governing earth-moving activities and shall neither be considered, nor subject to regulation as, structures for purposes of this ordinance.
The Ordinance contains legislative findings explaining its history, purpose, intent and rationale. All other ordinances in conflict with the provisions of the Ordinance are repealed to the extent of such conflict. The Ordinance contains a severability clause.
Copies of the complete Ordinance No. 01-2019 may be examined and/or obtained at the Dunmore Borough municipal building, located at 400 South Blakely Street, Dunmore, Pennsylvania 18512, during normal business hours, Monday through Friday, from 9:00 a.m. to 4:00 p.m. In addition, and in accordance with Section 610 of the Municipalities Planning Code, as amended, 53 P.S. § 10610, attested copies of the proposed Ordinance have been filed in the Lackawanna County Law Library (200 Washington Avenue, Scranton, PA 18503) and at The Times-Tribune newspaper (149 Penn Avenue, Scranton, PA 18503).
